The Ozamiz City Council held a special session on Friday to review a verified complaint filed by key members of the Barangay Senior Citizens Association (BSCA) Litapan against Punong Barangay Nieva Gomez Vergara of Barangay Vergara. The complaint, initiated by BSCA President-Elect Eneria Largo Tuastomban, BSCA Auditor-Elect Cecilia Largo, BSCA member Rolando Marcial, and other concerned residents, accuses Captain Vergara of authority abuse and ethical violations under the Local Government Code and the Code of Conduct and Ethical Standards for Public Officials.
The allegations highlight possible infractions of Section 60 of Republic Act No. 7160 (Local Government Code) concerning abuse of authority and Article 131 of Republic Act No. 6713 regarding ethical conduct and standards for public officials. The complainants assert that Captain Vergara interfered in the barangay’s senior citizens' election, allegedly attempting to advance personal interests by pushing her husband’s candidacy as president and withholding the required 0.5% senior citizens' budget allocation.
The Committee on Laws and Style of the Sangguniang Panlungsod, led by Councilor Atty. Marcelian "Mars" Tapayan, passed a motion directing Punong Barangay Vergara to file a verified response within 15 days from receipt of the summons, which will be issued by the Secretary of the Sangguniang Panlungsod.
Members of the BSCA previously raised concerns over Captain Vergara’s alleged interference in the senior citizens' association election, accusing her of obstructing and delaying the democratic process. Reports from senior citizens further claim that Vergara has resisted external oversight, asserting that no one has the right to question her leadership or influence the senior citizens’ election process in Barangay Litapan.
The complainants have requested a fair and thorough investigation, hoping for accountability and a resolution that upholds justice for the barangay's elderly residents. The Ozamiz City Council is expected to deliberate on Vergara’s response and determine the appropriate course of action following the 15-day period, underscoring the city’s commitment to accountability and ethical governance under Mayor Indy Oaminal’s administration.
